What Are the Terms of Service?

These Terms of Service (the “Terms”) govern your access to and use of the meetinvest services commercial version, including various websites, SMS, APIs, email notifications, applications, buttons, widgets, ads and commercial services, as well as any content, information, data, text, graphics, photos or other materials provided as a part thereof (collectively, the “Services”). The Services are provided, operated and maintained by meetinvest AG, a Swiss share corporation with its registered domicile at Lindenstrasse 4, 6340 Baar, Switzerland, company number CHE-271.966.615 (“meetinvest,” “we” or “us”).

The Terms describe in detail your rights and obligations relating to the Services. Please read them carefully. If you click on “I agree,” these Terms constitute a binding agreement between you and meetinvest. If you do not agree with the Terms, do not click “I agree.” You will then not be entitled and able to access and use the Services.

These Terms refer to the following additional terms, which also apply to your use of the Services:

What Does the Services Offer?

The Services offer access to the commercial demo version of the meetinvest single stock, expert based, algorithm driven Robo Advisor. Other than the free stock screening tool, it provides a proof of concept for you to assess a potential commercial use for the organization you are representing, that can lead into a cooperation with meetinvest.

This product works like a digital investment advisor based on multiple expert strategies. The criteria and formula for each of the strategies are defined by our interpretation of the investment approaches of various stock market experts after studying all their relevant literature available (books, research papers, reports, interviews). A portrayed author (or expert) may or may not actually invest in a passing stock. The idea of this Service is to systematically replicate the investment philosophy of the most prestigious and reputable investment heavyweights.

 

 

What Rights Do I Have?

You are granted by meetinvest a non-assignable and non-exclusive license to access and use the Services and any information, content and data provided as a part thereof for the sole purpose of assessing the Services as provided by us, in the manner permitted by these Terms. You may print off copies, and may download extracts, of any page(s) from the Services for the purpose of assessing a potential collaboration with meetinvest. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

 

 

How Do I Create a Personal Account?

You must create a personal account in order to assess the Services. When you create your personal account, you will have to choose your credentials. Your email address will serve as your username. Your password must be "strong,” i.e., you must use a combination of upper and lower case letters, numbers and symbols. You are solely responsible for maintaining the confidentiality and security of your credentials and for any activities that occur through the use of your credentials. meetinvest cannot and will not be liable for any loss or damage arising from your failure to comply with the above. If you forget or lose your password, you will be able to ask for the password to be reset and choose a new password. If you forget or lose your username, you will no longer be able to access your personal account. meetinvest will not be able to reconstruct your username or provide you with a new username. meetinvest will also not be able to recover your data. Please make sure that you remember credentials or store them in a secure place. meetinvest shall not be responsible if you cannot access your account because you forgot or lost your credentials. You should not reveal your credentials to anyone else. You are not entitled to assign or transfer your personal account to any third party. You agree to notify meetinvest immediately of any unauthorized use of your credentials or any other breach of security related to the Services. meetinvest reserves the right to require you to change your username and/or password if meetinvest believes that your credentials may violate the law or rights of third parties or no longer are secure.

 

 

How Can I Assess the Services?

The Services are made available to you only for informational purposes to assess a potential collaboration with meetinvest. The use of the Services for commercial purposes, including for marketing, promoting, offering, selling any products or services is prohibited. You are not permitted to create a personal account for or on behalf of another individual (other than yourself) or a legal entity of any kind. You are also not permitted to solicit, collect and/or use credentials of any other persons. You are not permitted to create more than one personal account. Further you are not permitted to replicate or re-engineer all or parts of the Services.

 

 

 

 

Why Am I Fully Responsible for the Use of the Services?

The Services and any tool, information, content and data offered as a part thereof are provided and maintained by meetinvest for the sole purpose of assessing a potential collaboration with meetinvest. Neither the strategies nor the formulas have been discussed, reviewed, supported or approved by any third party (including the authors (experts) of the portrayed investment strategies). All content on the stock selection tool had been created after studying the relevant and available literature about the topic. The output of the stock screening tool is computer generated, employing the formulas, but no human being or analyst has reviewed, checked or approved such results. There is a risk of loss when investing. The tools, information, content and data contained in the Services is for assessment purposes only. You hereby acknowledge and agree that neither meetinvest nor its representatives and employees make any representations, warranties or guarantees, express or implied, as to the accuracy, correctness, timeliness, regularity, completeness and up-to-dateness of the Services. Neither meetinvest nor its representatives and employees shall have any liability to you or any other person as a result of your access to and use of meetinvest and any Services, tools, information, content and data offered as a part thereof. You acknowledge and agree that you assume full responsibility for all actions, inactions, ideas, opinions and conclusions derived from the access to and use of the Services and any tool, information, content and data offered as a part thereof. All information has been obtained from sources, which are believed to be reliable, but accuracy and thoroughness cannot be guaranteed. Users are solely responsible for how they use the information and for their results. meetinvest does not guarantee the accuracy or completeness of the information or any analysis based thereon. Hypothetical performance is not necessarily indicative of future results. Hypothetical performance results have many inherent limitations: One is that they are generally prepared with the benefit of hindsight. In addition, hypothetical performance does not involve financial risk, and no hypothetical back-testing record can completely account for the impact of financial risk in actual investing. For example, the ability to withstand losses in a market correction or to adhere to a particular investment strategy in spite of temporary losses is a material point that can also adversely affect actual results. There are numerous other factors related to the markets in general or to the implementation of any specific investment strategy, which cannot be fully accounted for in the preparation of hypothetical performance results and all of which can adversely affect actual investment results. Unlike an actual performance record, simulated hypothetical performance results do not represent actual investing. Also, since the buys and sells have not actually been executed, the results may have under- or over-compensated for the impact, if any, of certain market factors, such as lack of liquidity. No representation is being made that any strategy calculated will or is likely to achieve profits or losses similar to those shown. What about Intellectual Property Rights?

You agree that the Services, including but not limited to graphics, user interface, and software used to provide the Services, contain proprietary information and material that is owned by meetinvest and/or its licensors, and are protected by applicable intellectual property and other laws, including, but not limited to, trademark and copyright laws. You agree that you will not use such proprietary information or materials in any way whatsoever except for use of the Services in compliance with these Terms. No portion of the Services may be reproduced in any form or by any means. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Services in any manner. The meetinvest icon and meetinvest logo are owned by meetinvest. You will not use the signs except with our prior written permission and in accordance with our Brand Usage Guidelines.

 

 

When Will I Have to Indemnify meetinvest?

You agree to indemnify and hold meetinvest and its shareholders, directors, officers, employees and third-party suppliers harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your access to and use the Services or violation of these Terms and applicable law. meetinvest reserves the right to seek remedies and damages to the fullest extent permitted by law, including, without limitation, legal action and/or criminal prosecution.

 

 

How Is meetinvest’s Warranty Limited?

The Services are provided “as is.” To the maximum extent permitted by law, meetinvest and its affiliates, as well as their respective shareholders, directors, officers, representatives and employees exclude all conditions, warranties, representations or other terms that may apply to the Services or any information, content and data provided on or through the Services, whether express or implied. Without limiting the generality of the foregoing, we exclude all conditions, representations, warranties or guarantees as to the accuracy, correctness, completeness and up-to-dateness of the Services and any information, content and data provided on or through the Services. To the maximum extent permitted by applicable law, the provisions of these Terms are in lieu of all other representations, warranties or guarantees concerning the provision of, failure to provide or delay in providing THE SERVICES that might, but for this clause, have effect between meetinvest and you or would otherwise be implied in or incorporated into these Terms, whether by statute, common law or otherwise, all of which are hereby excluded. To the maximum extent permitted by applicable law and without limiting the generality of the foregoing, meetinvest specifically does not represent, warrant or guarantee that the information, data or material included IN THE SERVICES will be accurate, complete, legal, reliable or available, or that meetinvest will be uninterrupted or error free. meetinvest specifically disclaims any responsibility and liability for inavertedly modifying, mutilating, destroying, deleting or failing to store any information and data you may upload, post, transmit, share or otherwise make available any information, content or data IN THE SERVICES.

 

 

How Is meetinvest’s Liability Limited?

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law. To the maximum permitted by applicable law, meetinvest or its shareholders, directors, officers, employees and third-party suppliers shall not be liable FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, FOR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, STRICT LIABILITY OR UNDER ANY OTHER LEGAL THEORY RESULTING FROM OR IN CONNECTION WITH THE SERVICES OR ANY USE THEREOF, INCLUDING, BUT NOT LIMITED TO, ANY DAMAGES ARISING OUT OF LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF USE OF the SERVICES, DOWN TIME AND USER’S TIME, EVEN IF meetinvest or its shareholders, directors, officers, employees and third-party suppliers HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

 

 

What Happens if the Services Are Discontinued?

meetinvest reserves the right to discontinue the Services (or any part, service or content thereof) at any time in its sole discretion without liability to you.

 

 

Applicable Law/Jurisdiction

The present Terms constitute the entire agreement between you and meetinvest, and govern your use of the Services. These Terms shall be subject to the laws of Switzerland. All disputes that may arise regarding these Terms shall be exclusively determined by the courts of the Canton Zug, Switzerland.
